Court Dismisses Ato Forson’s Mistrial Application in Ambulance Case

The High Court in Accra has dismissed an application by Minority Leader Cassiel Ato Forson for a mistrial and an inquiry into the conduct of the Attorney General in the ongoing ambulance case. The trial judge ruled that Ato Forson failed to provide statutory provisions warranting a mistrial or an inquiry into the Attorney General’s actions.

Ato Forson, on June 3, filed a supplementary affidavit in support of a motion for an order of mistrial, injunction, and/or stay of proceedings in the ambulance case involving himself and two others. His lawyers cited a leaked tape purportedly featuring a conversation between Attorney General Godfred Yeboah Dame and the third accused, Richard Jakpa. In the tape, Dame allegedly attempted to coach Jakpa to implicate Ato Forson in the trial.

The legal team argued that the Attorney General’s conduct constituted misconduct and called for the prosecution to be declared a mistrial. The affidavit emphasized the need to bring pertinent and relevant matters to the court’s attention to ensure a fair and just determination of the application. They proposed playing the audio recording in open court to substantiate their claims.

Ato Forson argued that failing to order a mistrial in light of the alleged misconduct and disregard for legal and ethical standards by the Attorney General could undermine public confidence in the judicial process. Despite these arguments, the court found no legal basis to grant the application for a mistrial or to investigate the Attorney General’s conduct.
