NDC Files Lawsuit to Halt EC’s Re-Collation of Results in Five Constituencies

The National Democratic Congress (NDC) has initiated legal action against the Electoral Commission (EC) to prevent the re-collation and redeclaration of parliamentary election results in five constituencies: Dome-Kwabenya, Okaikwei Central, Ablekuma North, Tema Central, and Obuasi East.

The EC previously declared the parliamentary results for Dome-Kwabenya, Okaikwei Central, Ablekuma North, and Tema Central as invalid due to procedural irregularities. This decision, announced by Samuel Tettey, Deputy EC Chair for Operations, stated that the initial collation processes did not comply with CI 127, despite police presence at the collation centers.

The NDC, along with five other applicants—Faustina Elikplim Akurugu, Baba Sadiq, Ewurabena Aubynn, Ebi Bright, and Samuel Aboagye—contends that the EC is “functus officio” after having declared results for these constituencies with NDC candidates as winners. They argue that the EC no longer has the authority to re-collate, recount, or redeclare the results.

The lawsuit seeks a declaration asserting that the EC’s actions to re-collate or redeclare results are unauthorized and a prohibition order preventing the EC from conducting re-collation, recounting, or redeclaration processes in these constituencies.

The dispute adds to existing tensions over the elections, with the NDC accusing the EC of procedural breaches and undue interference in the democratic process. The EC, however, has justified its actions as necessary to ensure compliance with electoral laws. This case is poised to test the judiciary’s interpretation of the EC’s authority post-declaration and could set a precedent for future electoral disputes.
